ARTICLE 2 CHARACTERISTICS OF THE PRODUCT SUBJECT TO SALE

The basicfeatures of the goods or services are available on www.sutgugumu.com. You canreview the basic features of the product during the campaign period.

 

The listedprices and the promises announced on the site are the sales prices. Theannounced prices and promises are valid until they are updated and changed. Theprices announced for a limited period are valid until the specified periodends.

 

The type,quantity, brand/model, color, number, sales price, payment method of thegoods/products/services consist of the information at the time the order isfinalized.

 

The shippingcost of the product will be paid by the SELLER.



ARTICLE 3 GENERAL PROVISIONS

3.1) The BUYER declares that they have read and been informed about the basiccharacteristics, sales price, and payment method of the product subject to thecontract, as well as the preliminary information regarding delivery on thesutgugumu.com website, and have given the necessary confirmationelectronically. By confirming this preliminary information electronically, theBUYER confirms that they have accurately and completely obtained the address,basic characteristics of the ordered products, prices including taxes, payment,and delivery information that the SELLER must provide to the BUYER before theconclusion of the distance contracts.

3.2) Theproduct subject to the contract is delivered to the BUYER or theperson/organization at the address indicated by the BUYER within the periodspecified in the preliminary information on the website, depending on thedistance of the BUYER's residence, provided that it does not exceed the legal30-day period for each product.

3.3) TheSELLER cannot be held responsible if the product ordered cannot be delivered tothe BUYER due to any problems encountered by the shipping company during thedelivery of the product to the BUYER.

3.4) TheSELLER is responsible for delivering the product subject to the contract in asound, complete manner, in accordance with the qualifications specified in theorder, and with, if available, warranty documents and user manuals.

3.5) TheSELLER may supply a different product of equal quality and price, with theexpress consent of the BUYER, before the fulfillment period of the contractualobligation expires.

3.6) If theSELLER cannot fulfill its contractual obligations regarding the ordered productor service, it informs the consumer of this situation before the fulfillmentperiod of the contractual obligation expires and may supply a different productof equal quality and price to the BUYER.

3.7) For thedelivery of the product, it is mandatory for this Preliminary Information Formto be confirmed electronically. If, for any reason, the product price is notpaid or is canceled in the bank records, the SELLER is considered to berelieved of its obligation to deliver the product.

3.8) Afterthe delivery of the product, if the relevant bank or financial institution doesnot pay the product price to the SELLER due to the unauthorized use of theBUYER's credit card by unauthorized persons in a manner not caused by theBUYER's fault, the BUYER is required to return the product to the SELLER within3 days, provided that it has been delivered to them. In this case, the shippingcosts are borne by the BUYER.

3.9) If theSELLER cannot deliver the product within the period due to force majeure orextraordinary circumstances such as transportation interruption, adverseweather conditions, it is obliged to notify the BUYER of the situation. In thiscase, the BUYER may exercise one of the rights to cancel the order, replace theproduct with an equivalent one if available, and/or postpone the deliveryperiod until the obstructive situation is eliminated. In case the BUYER cancelsthe order, the amount paid is refunded to them within 10 days. In payments madewith the BUYER's credit card, the product amount is returned to the relevantbank within 7 days after the cancellation of the order by the BUYER. Thereflection of this amount on the BUYER's account after it is returned to thebank is entirely related to the bank's transaction process. The BUYER acceptsin advance that the SELLER cannot intervene in any way for possible delays andthat it may take an average of 2 to 3 weeks for the amount refunded by theSELLER to be reflected in the BUYER's account by the bank.

1.2 – BUYER

ARTICLE 2 – SUBJECT

The subjectof this contract is the determination of the rights and obligations of theparties in accordance with the provisions of the Law on Consumer Protection No.6502 and the Regulation on Distance Contracts regarding the sale and deliveryof the product specified below, which the BUYER has ordered electronically fromthe SELLER's sutgugumu.com website.


ARTICLE 3 – PRODUCT SUBJECT TO THE CONTRACT

The type,quantity, brand/model, color, number, sales price, payment method of thegoods/products/services consist of the information at the time the order isfinalized.

ARTICLE 4 –GENERAL PROVISIONS

4.1 TheBUYER declares that they have read and been informed about the basiccharacteristics, sales price, including all taxes, payment method, and deliveryof the product subject to the contract, as well as the SELLER's full commercialname, clear address, and contact information on the toptanalim.com website andhave given the necessary confirmation electronically. By confirming thiscontract electronically, the BUYER confirms that they have accurately andcompletely obtained the address, basic characteristics of the ordered products,prices including taxes, payment, and delivery information that the SELLER mustprovide to the BUYER before the conclusion of the distance contracts.

4.2 Theproduct subject to the contract is delivered to the BUYER or theperson/organization at the address indicated by the BUYER within the periodspecified in the preliminary information on the website, depending on thedistance of the BUYER's residence, provided that it does not exceed the legal30-day period for each product. The shipping costs related to deliveryspecified in Article 3 will be covered by the SELLER.

4.3 If theproduct subject to the contract is to be delivered to a person/organizationother than the BUYER, the SELLER cannot be held responsible if theperson/organization to be delivered does not accept the delivery.

4.4 TheSELLER cannot be held responsible if the product ordered cannot be delivered tothe BUYER due to any problems encountered by the shipping company during thedelivery of the product to the BUYER.

4.5 TheSELLER is responsible for delivering the product subject to the contract in asound, complete manner, in accordance with the qualifications specified in theorder, and with, if available, warranty documents and user manuals.

4.6 TheSELLER may supply a different product of equal quality and price, with theexpress consent of the BUYER, before the fulfillment period of the contractualobligation expires.

4.7 If theSELLER cannot fulfill its contractual obligations regarding the ordered productor service, it informs the consumer of this situation before the fulfillmentperiod of the contractual obligation expires and may supply a different productof equal quality and price to the BUYER.

4.8 For thedelivery of the product, it is mandatory for the signed copy of this contractto be delivered to the SELLER and the price to be paid by the BUYER's preferredpayment method. If, for any reason, the product price is not paid or iscanceled in the bank records, the SELLER is considered to be relieved of itsobligation to deliver the product.

4.9 TheBUYER acknowledges and declares that the credit card information they enteredduring the purchase is correct and that they bear all legal and criminalliability for the use of this credit card. After the delivery of the product,if the relevant bank or financial institution does not pay the product price tothe SELLER due to the unauthorized use of the BUYER's credit card byunauthorized persons in a manner not caused by the BUYER's fault, the BUYER isrequired to return the product to the SELLER within 3 days, provided that ithas been delivered to them. In this case, the shipping costs are borne by theBUYER. If the BUYER does not return the product, the product price will betransferred to the SELLER's bank accounts without the need for any notice ifthe product price is not received for any reason or if the product price isrefunded to the credit card. The BUYER agrees and undertakes in advance thatthey will transfer the product price to the SELLER's bank accounts without anynotice if the product price is not received for any reason or if the productprice is refunded to the credit card.

4.10 If theSELLER cannot deliver the product within the period due to force majeure orextraordinary circumstances such as transportation interruption, adverseweather conditions


4.11 Points given to the customer through a campaign by the SELLER are onlyvalid for a single purchase. These points will not be returned even if theproduct is returned.

For paymentsmade by the BUYER via credit card, the product amount will be refunded to therelevant bank within 7 days after the cancellation of the order by the BUYER.Since the reflection of this amount on the BUYER's accounts after the refund tothe bank is completely related to the bank transaction process, the BUYERaccepts in advance that the SELLER cannot intervene in any way for possibledelays and that it may take an average of 2 to 3 weeks for the amount refundedby the SELLER to be reflected in the BUYER's account by the bank.**

 

Whenreturning the product to the SELLER, the original invoice presented to theBUYER at the time of delivery must also be returned (to ensure consistency inour accounting records), and if the invoice is not sent to the SELLER alongwith the product or at the latest within 5 days after the return of theproduct, the return process will not be carried out, and the product will besent back to the BUYER as is, with the shipping cost being paid by the BUYER.The phrase "return invoice" will be written on the invoice to bereturned with the product and signed by the BUYER.


ARTICLE 7 – DEFAULT OF THE DEBTOR

In the eventthat the BUYER goes into default, the BUYER agrees to compensate the SELLER forthe damages and losses incurred due to the delayed performance of the debt. Ifthe BUYER's default is due to the SELLER's fault, the BUYER will not be liablefor any damages or losses.


ARTICLE 8 – COMPETENT COURT
In the implementation of this Preliminary Information, the Consumer ArbitrationCommittees and the Consumer Courts in the place where the BUYER purchased thegoods or services and where he/she resides, up to the value announced by theMinistry of Industry and Trade, are authorized. The SELLER may submitcomplaints and objections regarding disputes within the monetary limitsdetermined annually in December by the Ministry of Industry and Trade to theConsumer Arbitration Committee or the Consumer Court in the place where theBUYER purchased the goods or services or where he/she resides. The monetarylimits are as follows:

Effectivefrom 28/05/2014:

a) It isobligatory to apply to the district consumer arbitration committees fordisputes with a value of less than two thousand Turkish Liras, to theprovincial consumer arbitration committees for disputes with a value of lessthan three thousand Turkish Liras, and to the provincial consumer arbitration committeesin provinces with metropolitan status for disputes between two thousand TurkishLiras and three thousand Turkish Liras. Applications cannot be made to theconsumer arbitration committees for disputes exceeding these values.

b) Fordisputes exceeding the specified value, applications must be made to theConsumer Court, and where there is no Consumer Court, to the Civil Court ofFirst Instance acting as the Consumer Court.

Thispreliminary information is made for commercial purposes.

Please Note: Before signing the cargo receipt, please check whether yourcargo package is damaged due to transportation. If your cargo package isdamaged for any reason, please do not sign any document related to the deliveryand return the cargo to the carrier for a report to be prepared. Your newproducts will be sent to you immediately by us. In case of receiving productswith damaged cargo packages, sutgugumu.com is not responsible for any damagesor deficiencies in the contents of the package.
